Terms of Service

Welcome, and thank you for choosing Fama (“Fama”, “we”, “us”, or “our”), operated by Sergey Sobolevski. These Terms of Service (“Terms of Service” / “ToS” / “Agreement”) govern your access to and use of our mobile application available on iOS (the “App” or “FAMA”), as well as any services, software, neural networks, or utilities provided through it (collectively, the “Services”).

By using the App or Services, you represent that you are of legal age to enter into this Agreement. To utilize generative artificial intelligence features, you explicitly confirm that you are at least 13 years of age (or the age of legal majority in your jurisdiction, whichever is higher).

1. Who We Are and What We Do

Fama develops and operates software-based products designed to enhance user creativity and digital expression. FAMA provides a curated catalog of AI photo presets: you select a preset, add your own photo, and the Services generate a stylized rendering of that photo using generative artificial intelligence.

1.1 Service Capabilities & AI Architecture

• Compute Processing: Generation tasks are routed through our server-side proxy hosted on Vercel (whose Terms are available at vercel.com/legal/terms and Privacy Policy at vercel.com/legal/privacy-policy) to OpenRouter, Inc. (openrouter.ai/terms, openrouter.ai/privacy), which executes image generation on third-party foundation models, including Google Gemini image models. These compute partners execute transient processing of your submitted photo for the sole purpose of returning a generated result; we do not retain your photos on our servers.
• Storage: Your uploaded photos and generated outputs are stored locally on your device. We do not operate cloud accounts or server-side galleries. Deleting the App deletes this local content.
• On-Device Access: Photos are selected through the iOS system photo picker; the App only receives the specific items you choose. The App does not scan your photo library and does not collect biometric identifiers.

1.2 Platform-Specific Terms

Access to FAMA is subject to the terms of the Apple App Store. You must maintain an active, valid Apple account and abide by Apple’s terms of service.

1.3 Commercial Use Licensing

• Paid Subscribers: If you maintain an active paid subscription (weekly or annual), you are permitted to use the App and the content you generate for commercial purposes, including marketing, advertising, and brand promotion.
• Free Users: Users utilizing free or trial tiers of the Services may use FAMA and any Output Content for personal, non-commercial purposes only.

1.4 Sponsored Presets

We may collaborate with partners to provide “Sponsored” presets within the App. Such elements will be explicitly labeled as “Sponsored” in the user interface.

2. Definitions

• “Credits” means virtual, in-app utility units that may be purchased or granted as part of a subscription and consumed to process generations using premium or high-resource AI models.
• “Content” means any material delivered through the Services, including designs, text, images, graphics, prompts, and metadata.
• “Fair Use Policy” means our reasonable usage limits designed to ensure stability, security, and availability of the Services and to manage the computational cost of generative AI. We may impose reasonable rate limits, feature restrictions, or Credit requirements, including for plans marketed as “unlimited”, and may modify this policy at any time at our sole discretion.
• “Input Content” means photos or other assets you submit to the Services.
• “Output Content” (or “Generated Content”) means the completed AI renderings returned to you via the App.
• “Subscriber” means any party purchasing a paid subscription.
• “User” includes any Subscriber and any person accessing the App or Services.

3. Minimum Age Requirements

Our Services are not intended for individuals under 13 years of age. If you are under 13, you are strictly prohibited from using the App or Services. Any party allowing a person under 13 to access the Services is in material breach of these Terms.

Due to the creative and unpredictable nature of generative AI outputs, you must be at least of the age of legal majority in your jurisdiction to use the generative features. If you suspect an underage user is accessing these features, please notify us at neuratradingai@gmail.com.

4. Subscriptions, Credits, and Billing

Core features of FAMA may be accessed free of charge, subject to limitations. Access to premium presets, advanced AI models, and watermark-free output requires a paid subscription.

4.1 Auto-Renewable Subscriptions

Subscriptions are billed through your Apple account. Payment is charged at confirmation of purchase; the subscription automatically renews unless cancelled at least 24 hours before the end of the current period. You can manage and cancel subscriptions in your device Settings > Apple Account > Subscriptions. Prices are shown in the App’s checkout interface prior to purchase.

4.2 Modifications and Fair Use

We reserve the right to modify, adjust, or discontinue features, pipelines, pricing structures, and subscription benefits at any time at our sole discretion. Plans marketed as “unlimited” are subject to the Fair Use Policy: access to high-resource generative models may be capped, metered, or require Credits.

4.3 Billing and Refunds

All purchases are executed through the Apple App Store; payments, cancellations, and refunds are handled by Apple. Fama cannot process refunds for App Store purchases. Refund requests can be submitted to Apple at reportaproblem.apple.com.

4.4 Credits

Credits are non-transferable, have no cash value, do not earn interest, and do not constitute private property. We reserve the right to regulate, modify, or eliminate Credits at any time.

4.5 Watermarks

Output Content generated by free (non-paying) Users may include a visible FAMA watermark. Free Users are prohibited from removing, cropping, masking, or otherwise bypassing this watermark. Watermark-free output requires an active paid subscription.

5. Content Licensing and Data

5.1 Ownership and Limited License

You retain complete ownership of your original Input Content. Subject to your compliance with these Terms, Fama hereby assigns to you all right, title, and interest in and to your resulting Output Content. We claim no ownership over your intellectual property. To operate the App and perform the Services, you grant Fama a non-exclusive, royalty-free, worldwide, fully-paid, transferable, and sub-licensable license to use, reproduce, modify, and process your Input Content solely for the purpose of performing the Services, including generating Output Content.

Fama will never use your private Input Content or Output Content for promotional, commercial, or marketing purposes without obtaining your explicit, separate opt-in consent.

5.2 Data Retention

Your photos and generated results are stored locally on your device. Photos submitted for generation are processed transiently by our compute partners (Section 1.1) and are not retained by us after processing. Our data practices are further described in our Privacy Policy.

6. Intellectual Property Rights

Subject to your ownership of Input Content and the rights assigned in Output Content, the App, the Services, and all native materials (software, text, native presets, interfaces, designs, and arrangements) are owned by Fama, its licensors, or proprietary providers, and are protected by copyright, trademark, and other intellectual property laws. “Fama” is a trademark of Sergey Sobolevski. You must not use our marks, logos, or slogans without our prior written authorization.

7. Prohibited Uses

You may use the App and Services only for lawful purposes and in accordance with these Terms. You agree not to use FAMA:

• In any manner that violates local, state, federal, or international laws or regulations.
• To exploit, harm, or attempt to exploit or harm minors.
• To generate, upload, or disseminate content that is defamatory, obscene, sexually explicit, hateful, violent, or harassing.
• To generate images of real persons without their consent, or to impersonate Fama, another user, or any other person or entity.
• To introduce viruses, Trojan horses, worms, logic bombs, or other malicious software.
• To decompile, reverse engineer, disassemble, or attempt to extract the source code of the App, our server software, or the underlying AI models.

7.1 Generative AI Safety Constraints

Because our Services leverage third-party neural network technologies accessed via OpenRouter, you warrant that you will not use these models to:

• Generate verifiably false information with the intent to harm others.
• Generate or disseminate personally identifiable information to facilitate harassment or stalking.
• Provide unauthorized medical advice, legal interpretations, or administration of justice.
• Facilitate fully automated decision-making that alters an individual’s legal rights.

8. Monitoring, Enforcement, and Termination

We reserve the right to monitor usage of the Services solely to prevent systemic abuse, block prohibited activities, and ensure technical stability. We do not pre-screen all user submissions, but we reserve the right to restrict access for Users who violate these Terms.

9. Copyright Complaints

We take claims of copyright infringement seriously and will respond to notices that comply with applicable law. 11. Dispute Resolution and Governing Law

These Terms and any claims arising out of or relating to these Terms or the Services shall be governed by the laws of the Republic of Belarus, without regard to its conflict of laws principles. Any dispute that cannot be resolved amicably within thirty (30) days of a written Notice of Dispute sent to neuratradingai@gmail.com shall be brought exclusively in the courts of the competent courts of the Republic of Belarus, and each party irrevocably submits to the personal jurisdiction and venue of those courts. You and Fama agree that claims may be brought only in an individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding.

12. Indemnification

You agree to defend, indemnify, and hold harmless Fama and its officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any and all third-party claims, demands, liabilities, damages, losses, costs, or fees (including reasonable attorneys’ fees) arising out of or relating to: your breach of these Terms; your use or misuse of the Services or any Output Content; your Input Content; any claim that your Input Content or Output Content infringes the intellectual property, publicity, or privacy rights of any third party; any commercial exploitation of Output Content generated by you; or your violation of applicable law. We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense. You shall not settle any claim that imposes any obligation on Fama without our prior written consent.
